Distribution of the interest part of an estate

 Nasihah (Advice): Sayyiduna Abdullah bin Abbaas (Radiyallahu Anhu) says that the Prophet (Sallallahu Alaihi Wasallam) gave him the following advice: “When you ask (for your needs), ask from Allah, and when you seek help, seek help from Allah.” (Tirmizi, Hadith #: 2516)
Question and Answer:
Q. We are winding up my father’s estate and have found one of his accounts have accumulated interest. When distributing the shares, do we also include the interest as part of the shares or should it be taken out first and then distribute the shares.

A. The interest should be disposed of first. It does not form part of the estate in Shari’ah and hence is not to be distributed.
